1. General
a. The information contained on this website is meant to provide general
information and guidance regarding the adherence to the SECTORAL DETERMINATION
7: DOMESTIC WORKER SECTOR, SOUTH AFRICA. This website merely advises the user
on the correct legal course of action regarding aspects of package and domestic
worker minimum employment conditions. It is however, the client’s
responsibilities to absorb and apply this advise.
b. This website does not address, and is not meant to address, the entire body
of local law and regulation governing the payroll process, or employment law.
Such laws and regulations change frequently and their effects can vary widely
based upon the number of employees, labour regulations, and other specific
facts and circumstances.
c. As UIF Solutions only supports registered employees who receive income below
the annual tax threshold, Insight IT Solutions hereby disclaims all liability
for any loss, damage or expense however caused, arising from the submission,
declaration or payment of employees’ tax for employees’ who receive income
above the annual tax threshold. The user of UIF Solutions further indemnifies
Insight IT Solutions and holds them harmless against all claims or actions
which may be instituted against Insight IT Solutions for loss or damage in respect of
the failure to submit, declare or pay employees’ tax to the South African
Revenue Service in respect of employees registered on UIF Solutions, and which
may be incurred by Insight IT Solutions arising out of the user's use of UIF
Solutions.
d. This Website contains information that is accurate at the time of
writing, to the best of our knowledge. It will be updated periodically as legal
changes are promulgated. Those who wish to access this website expressly agree
that use of this website is at their own risk. Neither Insight IT Solutions, its
affiliates nor any of their respective employees, agents, third party content
providers or licensers warrant that this website will be uninterrupted or error
free. Insight IT Solutions makes no representations or warranties as to this Web site
or any information provided on this Web site. Information provided on this Web
site is provided "as is" without warranty of any kind, either express or
implied.

2. Monthly Debit Order Terms and Conditions
a. Upon accepting the Customers authorisation to debit his/her account with the annual subscription fee online,
UIF Solutions will provide the Customer with complete
access to the service in the proceeding month.
b. The Customer must pay the monthly service charge and UIF contributions in
arrears on the last business day of each month. As a result of this method of
payment the first payslip will be available without payment. This payment will
be made by direct debit from the Customer's Bank Account. The entire monthly
service fee will be payable for example where the Customer acquires access to
the Service in the middle of the month, because of the fact that the entire
months payslips will be generated.
c. The Customer is liable for transaction fees on processed payments. This
process fee is however included in the monthly service fee.
d.Should the Customer wish to stop the debit order at any stage, they are
required to logon and uncheck the stop debiting me checkbox and this will
immediately delete the customers banking details from the database.

3. Annual Payment Terms and Conditions
a. Upon accepting the Customers authorisation to debit his/her account
with the annual subscription fee online, UIF Solutions will provide the
Customer with complete access to the service in the proceeding month. As a
result of the method of payment the first payslip will however be available
immediately without payment.
b. The Customer must pay the annual service charge and UIF contributions in
advance on the last business day of the annual anniversary month. This payment
will be made by direct debit from the Customer's Bank Account. The entire
monthly service fee will be payable for example where the Customer acquires
access to the Service in the middle of the month, because of the fact that the
entire months payslips will be generated.
c. The Customer is liable for transaction fees on processed payments. This
process fee is however included in the monthly service fee.
d. When the customer elects to pay the UIF Solutions service fee, an annual
discount will be applicable. This places the customer in a situation where if
he/she decides to discontinue using the services of UIF Solutions before the
anniversary of the commencement of use then the annual service fee paid will
under no circumstances be refundable.

4. Termination
Without limiting Insight IT Solutions’ right to terminate for any other reason, the
agreement may be terminated on seven days notice in the event that:
a. any regulatory approvals or government or state permissions, consents,
authorisations and the like, if any, required to provide the Service or any
part of it are withdrawn, cancelled or suspended, if the regulatory
intervention requires an immediate termination of the service, no notice period
will be given;
b. any banking or account keeping facilities required to be kept by the
Customer under the agreement are terminated, suspended or otherwise cancelled
by the client logging on and unchecking the stop debiting me check box.
c. the direct debit facility for the Customer's Bank Account in favour of Insight IT
Solutions is terminated, revoked or suspended; no notice period will be given;
d. the continued provision of the Service or required upgrades render the
provision of the Service uneconomical in Insight IT Solutions's reasonable opinion;
e. any representation or warranty made by the Customer in the agreement, or in
relation.
Where Insight IT Solutions is entitled to terminate the agreement, it may effect
termination either by notifying the Customer in writing or taking action to
terminate the Customer's access and use (and the access and use of Customers)
to the Service.
Termination of the agreement by Insight IT Solutions in accordance with the agreement
is without liability whatsoever to the Customer. Termination will not affect
any rights of Insight IT Solutions or the Customer that are accrued up to the time of
termination. All rights of Insight IT Solutions under the agreement are in addition
to its rights under the general law.
Wherever Insight IT Solutions has a right of termination under the agreement, it may
elect in its discretion to suspend the Customer's access to the Service, and
then either proceed to terminate the agreement or continue with it.

5. Limitation of liability and indemnity
a. Except as may be expressly set out in the agreement, Insight IT Solutions makes no
representation or warranty in connection with the Service or the services that
may be provided by third party participants as part of, or otherwise in
connection with, the Service.
b. Without limiting paragraph (a), the Customer acknowledges and agrees that
Insight IT Solutions cannot and does not promise that:
i. the Service is suitable for the Customer's particular circumstances or
purposes;
ii. the Service will operate without delay, interruption or failure;
iii. transactions or payments attempted by a Customer through the Service will
be successful;
iv. the Service will always be secure or protected from unauthorised access.
c. Insight IT Solutions will not be liable for:
i. any act or omission of any third party participant including, without
limitation, those of any third party participant who acts upon or is required
to act upon, but fails to act upon or delays in acting upon or process, a
payroll payment;
ii. any Claim, loss, damages or liability suffered or incurred by the Customer
arising in connection with any payroll payment, adjustment or other transaction
effected or attempted; and in particular, under no circumstances will be
responsible for any fraudulent, unauthorised or mistaken, transaction, payment
instruction, reversal or error correction made;
iii. any erroneous, mistaken, incomplete or multiple execution of a payroll
payment caused or contributed to by a Customer in connection with the
Customer's use of the Service;
iv. the approval or rejection of a payroll payment by the applicable bank or
others responding to, or acting upon a request,
v. any cause or event outside the reasonable control of Insight IT Solutions or a
third party participant;
vi. any delays howsoever occasioned in payroll payments being processed or
received;
vii. any breakdown, interruption or failure of, or to, any telecommunications
connections or Internet access used by the Customer, or a third party
participant;
viii. any loss of profit, indirect, consequential or incidental loss, damages,
liability or injury suffered or incurred arising in any circumstances
whatsoever in connection with the supply or failure to supply the Service, and
the Customer indemnifies and will keep Insight IT Solutions and each applicable third
party participant indemnified from and against any Claim, loss or liability
arising directly or indirectly from any negligent or fraudulent act or omission
of a Customer or the Customer (or persons under their control and direction),
or other conduct of the Customer or its employees in breach of the agreement or
the terms and conditions of a third party participant which the Customer is
required to observe, or breach of the terms and conditions that the Customer is
required to ensure that the Customer adheres to in accessing or using the
Service, such indemnity to include (without limitation) any and all legal costs
incurred (on a lawyer and own client basis) in connection with Insight IT Solutions
and each applicable third party participant enforcing or attempting to enforce
any of their rights.
Nothing in the agreement will exclude, restrict or modify any rights or
remedies which the Customer may have under any trade practice laws which under
such legislation or other laws cannot be excluded, restricted or modified by
agreement.

6. Privacy Policy
Insight IT Solutions respects your individual privacy. This Privacy Policy embodies
our commitment to its protection through adherence to fair electronic
information practices. This Policy puts you, the individual, in control of how
your personal information is processed. You have our promise that we will not
electronically process your personal information in any way that is
incompatible with this Policy.
Personal Information
All personal information gathered by UIF Solutions is NOT compiled in any form
of mailing list for solicitation purposes. Insight IT Solutions does not hire, sell
or share the names, addresses and e-mail addresses of any of its users with any
other company, user and/or third party unless obliged to do so by law or legal
process. Because of the nature of the services that UIF Solutions provides to
our customers, we are obliged to disclose your details and your domestic
employee’s details to the Unemployment Insurance Fund on a monthly basis. We
are undertaking this legal obligation on your behalf as a domestic employer.
Insight IT Solutions reserves the right to contact any business or persons whom is
listed, advertising or being hosted on UIF Solutions to advise them of any new
information or changes which may effect their interaction with the Internet
and/or UIF Solutions.

As UIF Solutions is an information portal, it contains links to other Web
sites. These sites however do not fall under any control of UIF Solutions and
therefore UIF Solutions cannot be held responsible for the privacy practices or
the contents of such other web sites.

7. Security
UIF Solutions assures the confidentiality of the information it has gathered by
maintaining strict internal codes of practice, which ensure the security and
confidentiality of information by limiting access to and use of this
